Terms of Service

These Terms of Service (“Terms”) govern your access to and use of CheckMyBroker (the “Service”), an independent service operated from Chișinău, Republic of Moldova (“we”, “us”). By using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. Acceptance

By accessing the Service, creating an account, or submitting any content, you accept these Terms and our Privacy Policy. You must be at least 18 years old and using the Service for business purposes.

2. The Service

CheckMyBroker is an information service that compiles public records about US freight brokers and hosts payment reports submitted by carriers. It is offered only for business-to-business freight-broker verification by motor carriers and their agents. It is not legal, financial, or credit advice and is not offered for any purpose governed by the Fair Credit Reporting Act. Do not use it to make personal credit, employment, insurance, or tenancy decisions.

Scores and filing labels are CheckMyBroker’s own public-record summaries, based on the disclosed FMCSA fields identified on each profile, as of the stated date. They are not recommendations to enter or avoid a transaction. Carrier payment reports are shown separately, labeled as user-submitted accounts that CheckMyBroker has not independently verified, and do not affect the score or label. No broker or carrier can pay to change or expedite a score, label, or report. Public-record fields follow documented source refreshes and corrections; reports may change through neutral moderation, appeal, documented correction, or a valid legal requirement; methodology changes are versioned.

3. Accounts

You are responsible for the accuracy of the information you provide and for activity under your account. Keep one account per person or business and keep your credentials secure. We may suspend or terminate accounts that abuse the Service, submit false content, or violate these Terms.

The Service includes a Free plan with published limits. Features and limits may change prospectively under updated terms. Joining a launch or pricing list is an expression of interest only: it does not create a purchase, subscription, price guarantee, card authorization, or automatic conversion. Any future paid service requires a separate offer and checkout acceptance stating the then-current price and terms.

4. Acceptable use

You agree not to: scrape or harvest the Service at scale or through automated means beyond ordinary use; resell, redistribute, or build a competing database from our data; exceed published rate limits or attempt to circumvent them; upload unlawful, defamatory, or infringing content; or use the Service for any unlawful purpose. We may enforce technical rate limits and revoke access for abuse.

5. User content

Payment reports, disputes, and other content you submit must comply with our Content Policy, be truthful, and be based on your own first-hand experience where applicable. You must disclose material relationships and may not submit fake, paid, incentivized, duplicate, defamatory, private or infringing content. You grant us a non-exclusive, worldwide, royalty-free license to store, moderate, display and distribute that content as part of the Service. You retain ownership of your content. We apply the same moderation rules to positive and negative reports and do not restrict honest reviews of CheckMyBroker. We may approve, reject or hide content under the Content Policy, and brokers may request a right of reply or dispute data through the forms provided.

6. Broker and subject data; disputes

CheckMyBroker publishes information about freight brokers compiled from FMCSA public records and from payment reports submitted by carriers. If you are a broker or other subject of a profile, this section sets out how that information is displayed and how you may respond, even if you do not hold an account. We use only official public-record and business-registry fields for broker profiles and label carrier payment reports as unverified individual experiences. If you believe a data point is inaccurate, your remedy is the dispute and right-of-reply process on the profile page, which we review and correct where the public record is wrong; we do not accept payment to alter, remove, or expedite any profile, score, or report. Third-party names and MC numbers are used only to identify the brokers described; we claim no affiliation with, or endorsement by, them.

7. Historical Recovery drafts

New Recovery document generation is paused pending US transportation-law and state compliance review. Previously saved draft content is quarantined because it was not reviewed by a lawyer and may contain unsupported assumptions or incorrect legal statements; account history shows metadata only. Contact support to exercise an applicable data-access right. CheckMyBroker is not a law firm, does not provide legal advice or representation, does not determine liability or recommend a remedy, and does not send, sign or file documents. No attorney-client relationship or legal privilege is created.

8. Disclaimers

The Service is provided “AS IS” and “AS AVAILABLE”, without warranties of any kind, express or implied. Data is drawn from public sources and user submissions and may be incomplete, delayed, or inaccurate. We do not warrant the accuracy, completeness, or timeliness of any information. Always confirm critical details against the official FMCSA record before acting.

9. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or business, arising from your use of the Service. Our total liability for any claim will not exceed the greater of the amounts you paid us in the twelve (12) months before the claim or US $100.

10. Indemnification

To the extent permitted by applicable law, you agree to indemnify the operator of CheckMyBroker from a third-party claim arising from content you submit, your unlawful use of the Service, or your violation of these Terms or a third-party right.

11. Dispute resolution

Before filing a claim, you and we agree to make a good-faith attempt to resolve the issue by written notice to the contact below. If it is not resolved, a claim may be brought only before a court or other forum that has jurisdiction under applicable law. Nothing in these Terms waives a right or remedy that cannot lawfully be waived. These Terms do not impose mandatory arbitration, a class-action waiver, or a jury-trial waiver.

12. Applicable law

The law applicable to these Terms and any dispute is determined by the forum’s conflict-of-laws rules and any non-waivable law that applies to you. We do not claim a contractual connection to Delaware or another US state that has not been established.

13. Copyright complaints

Send copyright complaints to legal@checkmybroker.ai and identify the protected work, the material and URL at issue, your contact information, authority to act, and the basis for the request. We review sufficiently documented complaints and may remove or disable access where appropriate. We are not currently registered with the U.S. Copyright Office’s Designated Agent Directory and do not claim a 17 U.S.C. §512 safe harbor.

14. Export and sanctions

Do not access, provide, export, re-export, or use the Service where doing so is prohibited by sanctions, export-control, or trade laws applicable to you or to us.

15. General

If any provision of these Terms is held unenforceable, the remaining provisions stay in effect. Neither party is liable for delay or failure caused by events beyond its reasonable control. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Service and supersede any prior agreement. Nothing in the Service is legal, financial, or tax advice.

16. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by a new effective date at the top of this page, and continued use of the Service after changes take effect constitutes acceptance.
